1. Acceptance
By creating a BharaKhata account or using the app, you agree to these terms. If you don’t agree, don’t use the app.
2. Who can use it
You must be 18+ and legally capable of entering a contract in Bangladesh. You’re responsible for everything done under your account.
3. What BharaKhata is
BharaKhata is a tool that helps owners, tenants, and caretakers manage residential and commercial rental properties — track leases, generate invoices, log payments, and communicate. BharaKhata is not a payment processor, broker, lawyer, or escrow service. We do not hold money for you. Payments shown in the app are records of payments you made through other channels (cash, bKash, bank transfer, etc.).
4. Your responsibilities
- Accurate information. Don’t impersonate someone, use a fake phone number, or upload a NID that isn’t yours.
- Lawful use. Don’t use BharaKhata to harass, defraud, blackmail, or threaten anyone, or to violate any Bangladeshi or applicable international law.
- Real lease. When you create a lease in the app, you confirm there is or will be a real underlying rental agreement between the parties.
- No reverse-engineering. Don’t scrape, decompile, or attempt to defeat any security control.
5. Owner ↔ tenant relationship
Disputes between owner and tenant about rent, payment, eviction, or property damage are between you and the other party. BharaKhata does not mediate, arbitrate, or judge such disputes. We may comply with valid Bangladeshi court orders to produce records.
6. Fees
BharaKhata is free for tenants and free for owners up to a small number of tenants; paid plans apply as an owner’s building grows. We will always show the price in-app before you subscribe, and give notice before changing what you currently pay.
7. Account termination
- By you: delete your account anytime from Settings → Account → Delete. We will remove your personal data within 30 days, subject to legal retention requirements.
- By us: we may suspend or terminate an account that violates these terms or that we reasonably suspect is fraudulent. We’ll give you notice unless prevented by a security or legal concern.
8. Disclaimer of warranties
BharaKhata is provided “as is”. We don’t guarantee the app will be uninterrupted, error-free, or fit for any particular purpose. We’re not liable for losses caused by:
- delayed or undelivered notifications,
- downtime of Supabase, Cloudflare, Google, Meta, or bdbulksms.net,
- data loss caused by your own device,
- mistakes you make entering lease, payment, or invoice data.
9. Limitation of liability
To the maximum extent permitted by Bangladeshi law, our total liability for any claim arising from the use of BharaKhata is capped at the greater of (a) the fees you paid us in the 12 months before the claim or (b) 5,000 BDT.
10. Indemnification
You agree to defend and indemnify us against any claim brought by another party because of how you used the app or breached these terms.
11. Changes
We may change these terms. Material changes will be announced in-app at least 14 days before they take effect. Continued use means you accept the new terms.
12. Governing law
Bangladeshi law. Disputes go to the courts of Dhaka.
